1. Introduction
Welcome to AnglerHive. These Terms of Service ("Terms") govern your access to and use of the AnglerHive website, mobile application, and related services (collectively, the "Services"), operated by AnglerHive ("we", "us", or "our").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and AnglerHive.
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website and, where appropriate, through the app or via email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
2. Eligibility
To use AnglerHive, you must:
- Be at least 13 years of age. If you are under 18, you must have permission from a parent or legal guardian
- Have the legal capacity to enter into a binding contract
- Not be barred from using the Services under applicable South African law or any other jurisdiction
- Provide accurate, current, and complete information during registration
By using the Services, you represent and warrant that you meet all of these requirements.
3. Your Account
3.1 Registration
To access certain features of AnglerHive, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
3.2 Account Security
You agree to:
- Use a strong, unique password for your account
- Keep your login details secure and confidential
- Not share your account with anyone else
- Log out of your account at the end of each session, especially on shared devices
3.3 Account Termination
You may delete your account at any time through the app settings. We may also suspend or terminate your account if you violate these Terms, engage in fraudulent or illegal activity, or if required by law. Upon termination, your right to use the Services ceases immediately.
4. Acceptable Use
AnglerHive is a community built on respect, honesty, and a shared passion for fishing. You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Services.
4.1 Prohibited Conduct
You may not use AnglerHive to:
- Post or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Upload or distribute viruses, malware, or any other harmful software
- Attempt to gain unauthorised access to our systems, servers, or other users' accounts
- Collect or harvest personal information about other users without their consent
- Use automated scripts, bots, or scrapers to access or interact with the Services
- Post false, misleading, or deceptive information, including fake catches or manipulated photos
- Engage in spam, unsolicited advertising, or promotional activities without our consent
- Violate any applicable local, provincial, or national laws, including fishing regulations and conservation rules
- Promote or facilitate illegal fishing practices, poaching, or the sale of protected species
4.2 Content Standards
All content you post on AnglerHive must:
- Be accurate and truthful to the best of your knowledge
- Respect the intellectual property rights of others
- Not contain hate speech, discrimination, or content that promotes violence
- Not include explicit or sexual content
- Be relevant to fishing, the outdoors, or the AnglerHive community
5. User-Generated Content
5.1 Your Content
You retain ownership of any content you create and post on AnglerHive, including photos, videos, comments, reviews, and catch logs ("User Content"). By posting User Content, you grant AnglerHive a non-exclusive, royalty-free, worldwide, sublicensable licence to use, display, reproduce, modify, and distribute your content for the purpose of operating, promoting, and improving the Services.
5.2 Content Moderation
We do not pre-screen all User Content, but we reserve the right to review, remove, or edit any content that violates these Terms or that we deem inappropriate, at our sole discretion. We are not responsible for User Content posted by other members.
5.3 Reporting Content
If you believe any content on AnglerHive violates these Terms or your rights, please report it using the in-app reporting tools or contact us at hello@anglerhive.co.za.
6. Marketplace and Transactions
6.1 Gear Marketplace
AnglerHive may provide a marketplace where users can buy, sell, or trade fishing gear. We are not a party to any transaction between users and do not guarantee the quality, safety, or legality of items listed.
6.2 Buyer and Seller Responsibilities
When using the marketplace:
- Sellers must accurately describe items, including condition, defects, and specifications
- Buyers must pay the agreed price promptly and communicate clearly with sellers
- Both parties are responsible for arranging safe payment and delivery
- We recommend meeting in public places for local exchanges
- AnglerHive is not responsible for disputes, refunds, or failed transactions between users
6.3 Prohibited Items
The following may not be listed or sold on the AnglerHive marketplace:
- Illegal fishing equipment or gear used for poaching
- Protected or endangered species (alive or as trophies)
- Counterfeit or stolen goods
- Weapons, explosives, or hazardous materials
- Items that violate any applicable law or regulation
7. Tournaments and Competitions
7.1 Participation
By entering any AnglerHive tournament or competition, you agree to abide by the specific rules published for that event, in addition to these Terms.
7.2 Fair Play
All tournament entries must be truthful and verifiable. You may not:
- Submit photos of catches from outside the tournament period or area
- Manipulate or edit catch photos to misrepresent size or species
- Use multiple accounts to gain unfair advantage
- Collude with other participants to manipulate results
Violation of fair play rules may result in disqualification, forfeiture of prizes, and account suspension.
7.3 Prizes
Prizes are awarded at our discretion based on the published rules. We reserve the right to withhold prizes if we suspect cheating or rule violations. Prize winners may be required to provide proof of identity.
8. Intellectual Property
8.1 Our Content
All content provided by AnglerHive, including the app design, logos, branding, text, graphics, software, and features, is owned by or licensed to us and is protected by South African and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our written permission.
8.2 Trademarks
"AnglerHive", "Your Fishing Buzz", and our logos are trademarks of AnglerHive. You may not use these marks without our prior written consent.
8.3 Feedback
Any feedback, suggestions, or ideas you provide to us about the Services may be used by us without obligation or compensation to you.
9. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Services, you agree to the collection and use of your data as described in the Privacy Policy.
We process personal data in accordance with South Africa's Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable data protection laws.
10. Disclaimers and Limitations
10.1 Service Availability
We strive to keep AnglerHive available at all times, but we do not guarantee uninterrupted access. The Services may be temporarily unavailable for maintenance, updates, or reasons beyond our control.
10.2 No Warranty
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be error-free, secure, or free from viruses or harmful components.
10.3 Fishing Forecasts
Our fishing forecasts, bite predictions, and weather data are provided for informational purposes only. We do not guarantee fishing success, safety, or accuracy of conditions. You are solely responsible for your fishing decisions and safety on the water.
10.4 Limitation of Liability
To the maximum extent permitted by law, AnglerHive and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the Services shall not exceed the amount you have paid to us in the 12 months preceding the claim, or R1,000 (One Thousand South African Rand), whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless AnglerHive and its affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Services
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Your interactions with other users, including offline meetings
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
12.2 Dispute Resolution
Before initiating any legal proceedings, we encourage you to contact us directly at hello@anglerhive.co.za to attempt to resolve the dispute informally. We are committed to addressing concerns promptly and fairly.
13. Third-Party Services
AnglerHive may contain links to or integrations with third-party websites, services, or content (e.g. payment processors, social media platforms, weather data providers). We are not responsible for the content, privacy practices, or terms of use of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and AnglerHive regarding your use of the Services and supersede all prior agreements, understandings, and communications.
